Information clause for the telephone call recording system (TAURON Polska Energia S.A.)


1. DATA CONTROLLER

2. DATA PROTECTION SUPERVISOR
We have appointed the Data Protection Supervisor who can be contacted by writing to:

3. PURPOSE OF PERSONAL DATA PROCESSING
We will process your personal data provided to us during a telephone call for the purposes, in retention periods and under the legal basis defined below:
a. pursuant to Article 6(1)(f) of the GDPRii [the legitimate interests pursued by the Controller] in order to ensure the due handling of your notification - for a period of 3 years calculated from the end of the year in which the recording took place, b. pursuant to Article 6(1)(f) of the GDPR [the legitimate interests pursued by the Controller] for the purpose of potential identification, investigation or defence of claims - for the duration of the proceedings and the period of limitation of potential claims.
(i.e. 5 years from the end of the calendar year in which the notification took place)

4. RIGHTS ARISING FROM THE PROCESSING OF PERSONAL DATA
Due to the fact that we will process your personal data, you shall be granted the following rights:
a. the right to object,
b. the right of access to your personal data,
c. the right of rectification of your data,
d. the right of erasure (also referred to as the "right to be forgotten"),
e. the right to restrict the processing of personal data,
f. the right of data portability,
g. the right of access to the conclusions of the balancing test carried out to verify the existence of legitimate interests of the controller to process personal data.

5. CONTACT POINT THROUGH WHOM YOU CAN CLAIM EXERCISING YOUR RIGHTS
Should you wish to exercise your rights, you can contact us in one of the selected ways:

If you choose to exercise the rights conferred on you, we will respond to you regarding the processing of your request no later than one month after we have received your request.

6. THE RIGHT TO LODGE A COMPLAINT WITH THE SUPERVISORY AUTHORITY
If you believe that we infringe any legal regulations by processing of your personal data, you have the right to lodge a complaint to the supervisory authority, the President of the Office for Personal Data Protection.

7. DATA PROCESSING OUTSIDE THE EEA (EUROPEAN ECONOMIC AREA)
Your personal data may be transferred outside the EEA. Such a situation may arise in connection with the outsourcing of certain services/activities to entities established outside the EEA or processing data outside the EEA. Your personal data may only be transferred to such third countries (countries outside the EEA) or entities in third countries for which an adequate level of data protection has been confirmed by the decision of the European Commission, standard data protection clauses have been applied in contracts with those entities or appropriate other safeguards have been applied, as referred to in generally applicable legal regulations.
In connection with the transfer of the data outside the EEA, you may request further information on the relevant safeguards in this regard, obtain a copy of these safeguards or information on the place where they are available by contacting the Data Protection Supervisor as indicated in this notice.

8. RECIPIENTS OF YOUR PERSONAL DATA
The anticipated recipients of your personal data include:
a. entities authorised to receive your personal data under relevant legal regulations,
b. entities that provide postal or courier services,
c. entities that assist us in handling correspondence,
d. entities that provide us with consultancy, advisory, audit, legal, tax, accounting assistance services,
e. entities that provide document archiving services,
f. entities that operate ICT systems and provide ITiii Services, - to the extent necessary for the achievement of purposes for which your personal data are processed.

Glossary:
iController - means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law - Article 4(7) of GDPR.

iiiIT Services - mean tools that enable the execution of defined business processes and allow for simultaneous, efficient and fast communication of many people employed or cooperating in TAURON Group Entities that use access to IT Services and consequently ensure the required cooperation between individuals employed or cooperating in TAURON Group Entities who use access to IT Services. The processing of users’ data in the IT Services is necessary for their due performance of their duties.
