Receiving response to request for arbitration from AM Global Holding S. à r.l., ArcelorMittal Long Products Europe Holding S. à r.l. and ArcelorMittal Poland S.A.
In reference to current reports No. 2/2024 of January 2, 2024, No. 3/2024 of January 4, 2024, No. 4/2024 of January 9, 2024, No. 6/2024 of January 12, 2024 and No. 54/2024 of October 1, 2024 TAURON Polska Energia S.A. (“Issuer”) informs that on October 30, 2024 it received response to request for arbitration from AM Global Holding S.à r.l. with its seat in the Grand Duchy of Luxembourg (“Leading Shareholder”), ArcelorMittal Poland S.A. with its seat in Dąbrowa Górnicza (“AMP”) and ArcelorMittal Long Products Europe Holding S.à r.l. with its seat in the Grand Duchy of Luxembourg concerning resolution of dispute related to lack of payment by the Leading Shareholder of the sales price for the shares in TAMEH Holding sp. z o.o. (“TAMEH”) with its seat in Dąbrowa Górnicza held by the Issuer (“Response to request”). In Response to request, the Leading Shareholder filed a counter-claim in which it requests the Issuer to pay PLN 598,098,090.30 with statutory interest for delay calculated from February 14, 2024 until the date of payment, as payment of the price for shares in TAMEH held by the Leading Shareholder and AMP. In the opinion of the Issuer the claims of the Leading Shareholder are unfounded.
